In Article 11 of the current version of the draft WIPO Broadcasting Organizations Treaty, broad exceptions would be provided not only to the protection of signals but also to the rights in the works and other protected materials carried by the signals – without the control of the three-step test. Furthermore, under Article 12(3) it would be free without any conditions to circumvent PMs in order to enjoy the exceptions. All this would lead to multiple conflicts with the TRIPS Agreement, the Berne Convention, the three WIPO ‘Internet Treaties’ (the WCT, the WPPT and the BTAP).
In principle, the non-derogation clause in Article 1(1) of the draft Treaty might be suitable to eliminate the conflicts with the international copyright and related rights treaties. They are, however, so numerous and serious that it would not be appropriate to leave all the conflicts to the non-derogation clause. In order to bring the draft Treaty into accordance with the above-mentioned treaties, it would be necessary to reconcile the provisions on the specific exceptions under Article 11(1) of the draft Treaty with the requirements of Berne Convention, and most importantly, all the exceptions and limitations would have to be subject to the three-step test as provided in Article 9(2) of the Berne Convention, in Article 13 of the TRIPS Agreement, in Article 10 of the WCT, in Article 16 of the WPPT, in Article 13 of the BTAP – and even in Article 11 of the Marrakesh VIP Treaty. Furthermore, the applicability of exceptions and limitations where TPMs are used would have to be regulated in accordance with the fine-tuned agreed statement adopted in Beijing concerning Articles 13 (on exceptions and limitations) and 15 (on technological protection measures) of the BTAP.
